Haki ya mwajiriwa kuchukua mikakati inayofaa ili kuhakikisha yuko salama akiwa kazini.

Mwajiriwa ana wajibu wa kuchukua mikakati inayofaa ili kuhahakisha yuko salama akiwa kazini. Sehemu ya 13 (1) ya sheria ya afya na usalama katika sehemu za makazi  nambari 15 ya mwaka wa 2007 ilnaifanya kuwa lazima kuwa kila mwajiriwa anafaa kujihakikishia usalama wake. Katika kesi ya Mohammed Farah  dhidi yaKenya Ports Authority [1988-1992] 2 KAR 283, mahakama ilisema kuwa mtu hawezi kungoja ghadi kupatwa na mkasa kisha kuanza kujiondolea lawama , mwajiriwa huyu ana wajibu iwapo hana hatia ya kukosa umakini ili kuweza kuzuia majeraha kazini. Hili linamaanisha kuwa mwajiriwa anafaa kuchukua hatua zinazofaa kuhakikisha usalama katika sehemu za kazi.
